自張蘊古之死，法官以出罪為戒；時有失入者，又不加罪。上嘗問大理卿劉德威曰：「近日刑網稍密，何也？」對曰：「此在主上，不在群臣，人主好寬則寬，好急則急。律文：失入減三等，失出減五等。今失入無辜，失出更獲大罪，是以吏各自免，競就深文，非有教使之然，畏罪故耳。陛下倘一斷以律，則此風立變矣。」上悅，從之。由是斷獄平允。
